In the case Carlock vs. Williamson the county is prepared to settle over a wrongful death lawsuit that involved spoliation of evidence.
In 2007, Amon Paul Carlock, who was recognized as Klutzo the Clown was indicted for the possession of child pornography, and engaging in sexual conduct with minors at a Philippines Orphanage. He died in jail after a confrontation with jailers where they would ultimately tazed him to death in a last ditch effort to restrain him. Emails pertained to Carlock from the jail staff have been destroyed but U.S. District Court Judge Sue E. Myerscough rules that the emails were erased through ignorance and not bad faith. Ultimately a settlement of $2.6 million dollars has been reach between Sangamon County Board and Carlock’s family.
